I have a patio so tree is in a pot.
Maples need sun to grow properly and prevent disease. You might be able to get away with part shade but mostly shade probably won't work. Japanese maples do well in shade, some cultivars more than others. If you want an evergreen, yews can tolerate shade.
Here is a publication that lists trees for container culture. Look up a tree you are interested in to find out if it can tolerate shade.

A garden friend suggested we plant "stateside" maples in our blank yard. What does he mean by this?
He may mean "Streetside" Maple. This is a cultivar of Red Maple tree.
It’s a royal red maple
It will self-clean. Removal before it is ready to fall off may lead to infection. Unfortunately, your photo did not come through, so I am unable to see the state of the tree.
Here are some articles that will help:

i would like to know what kind of tree this is and how to care for it.
They both look like Japanese maples and probably one or the other started as a sucker below the rootstalk. You might need to examine it closely and see which branches are coming out below the rootstock and remove them. (I like the more dissected one myself!)
Here is care information:

grew tree from seedling. 2 1/2 to 3 yrs old. 11ft tall base is 1 1/2 in dia.
This usually happens with a lack of light or if the roots run out of space. Stretching will be a maple's response. Try increasing light or putting it into a bigger container, if that is where it is, with fresh soil and compost.
This article will help you with the care of maples: https://www.gardeningknowhow.com/ornamental/trees/maple/growing-maple-trees.htm
My tree has Maple Tar Tree spot - a 12 year old maple. The leaves are dying and falling off. is there anything I can do? this is the worst it has been, although the tree gets it most years. thank you
The fungus moves with the wind so there is not much you can do to prevent it. The good news is it doesn't really hurt the tree but is unsightly. When the leaves fall, the fungus goes with it. The challenge is trying to prevent it the next year.
Start by cleaning up the fallen leaves and disposing of them in the trash. Reducing moisture buildup can also help. Here is more:

Wrong! Please don't promote Norway Maple! It is a horrible invasive weed in North America. At the same time, it grows poorly in urban settings and often ends up rotting with large branches falling off, doing untold damage, and then has to be removed. (https://www.gardeningknowhow.com/ornamental/trees/maple/growing-norway-maple-trees.htm)
In order to include information for ALL gardeners, we must include information for those that wish to grow this tree in order to be considerate of our entire audience.
Almost all plants and trees have the capacity to become invasive given the proper environment, and it is up to each individual as a responsible gardener to do proper research before planting any plant.
