Dying tree

I have just moved to a new garden and the tree in the garden has no leaves at the top. It is bare. There are a lot of shoots on the side of the tree with lots of leaves. Can you tell me if this tree is dying?

The fact that there are shoots and leaves growing on the side of the tree would signal that it is still very much alive. However, it could be stressed. It does sound as if it needs to be pruned back, cutting the top back by a third this year, and if needed, another third next year. Also, remove any other dead or unsightly branches. While pruning, keep an eye out for insect pests or other possible symptoms that may be affecting the tree. Just in case, you could treat it with neem oil, which is a safe and effective insecticide and fungicide.
