Massive Tree From Neighbours Garden.

Question

I am having a lot of trouble from a tree in my neighbours garden. Due to the size of it, it now shadow’s most of my garden until midday and in winter all the leaves fall into my garden and are ruining my lawn. But when requested to get it cut he said it’s not his tree it was there when they moved in. Is he wrong and should he get it cut. Thank’s if anybody can help.
